These Terms of Sale (“Terms”) govern the purchase of artworks and related items (“Artwork” or “Artworks”) through the Arthoods website at www.arthoods.com (the “Site”).
Please read these Terms carefully before placing an order. By placing an order through the Site, you confirm that you have read, understood, and agree to be bound by these Terms.
1. About Arthoods
1.1 Arthoods operates a curated online marketplace through which artworks are listed by independent artists.
1.2 Unless expressly stated otherwise on the Site, the contract for the sale and purchase of an Artwork is made directly between the buyer (“Buyer”, “you”, “your”) and the relevant artist or seller (“Artist”).
1.3 Arthoods acts as a disclosed intermediary and platform provider. Arthoods facilitates the listing of Artworks, the checkout process, communication between Buyer and Artist, and related customer support.
1.4 Arthoods may collect and hold payment in connection with a transaction and may release funds to the Artist after delivery and expiry of any applicable cancellation period, subject to any dispute, chargeback, return request, or suspected breach of these Terms or any applicable agreement.
1.5 Unless expressly stated otherwise, Arthoods does not itself create, own, store, inspect, package, or ship the Artwork.
2. Eligibility to Purchase
2.1 By placing an order through the Site, you confirm that:
you are legally capable of entering into a binding contract;
all information you provide is accurate and complete; and
you are authorised to use the payment method submitted with your order.
2.2 If you place an order on behalf of a business or other legal entity, you confirm that you have authority to bind that entity to these Terms.
3. Orders and Contract Formation
3.1 All orders placed through the Site are subject to acceptance and availability.
3.2 The listing of an Artwork on the Site is an invitation to treat and does not constitute a binding offer.
3.3 When you place an order, you make an offer to purchase the relevant Artwork in accordance with these Terms.
3.4 A binding contract for sale is formed only when Arthoods sends written confirmation accepting the order (“Order Confirmation”).
3.5 Arthoods reserves the right to refuse, reject, suspend, or cancel any order before dispatch, including where:
the Artwork is unavailable;
there is an error in price, description, or listing information;
payment cannot be authorised or verified;
fraud, unlawful activity, misuse, or bad faith is suspected; or
fulfilment or delivery is not reasonably possible.
3.6 If an order is cancelled after payment has been taken, the relevant amount will be refunded to the original payment method in accordance with applicable law.
4. Artwork Information and Availability
4.1 Arthoods and the Artist aim to ensure that Artwork descriptions, dimensions, prices, and images are accurate at the time of publication.
4.2 However, you acknowledge that:
Artworks are often original, handmade, or produced in limited form;
colours, tones, and textures may appear differently depending on screen settings and photography;
dimensions may be approximate unless expressly stated otherwise; and
minor variations in colour, tone, texture, finish, or detail do not of themselves constitute a defect, fault, or misdescription.
4.3 Information relating to authorship, originality, medium, date, and provenance is provided by the Artist unless otherwise stated. Arthoods does not independently verify all such information and gives no warranty in respect of it beyond any rights that cannot lawfully be excluded.
4.4 All Artworks are offered subject to availability. An Artwork may be withdrawn from sale at any time before Order Confirmation.
5. Price and Payment
5.1 All prices on the Site are shown in GBP (£) unless otherwise stated.
5.2 Prices may exclude shipping costs, customs duties, import VAT, local taxes, handling fees, and other charges unless expressly stated otherwise.
5.3 Arthoods reserves the right to amend prices at any time before an order is accepted.
5.4 If a clear and obvious pricing or listing error is identified after an order is placed, Arthoods reserves the right to cancel the order and refund any amount paid.
5.5 Payment must be made in full at checkout using a payment method made available on the Site.
5.6 Arthoods may use third-party payment service providers to process transactions securely. Payment processing may be subject to the separate terms and privacy policies of those providers.
5.7 Arthoods may hold payment temporarily and may delay release of funds to the Artist until:
delivery has been confirmed;
any applicable cancellation period has expired; and
no valid dispute, return request, chargeback, or claim remains outstanding.
6. Shipping and Delivery
6.1 Unless expressly stated otherwise in writing, the Artist is responsible for packaging, dispatch, and shipment of the Artwork to the Buyer.
6.2 The Artist is expected to use appropriate packaging and a tracked and insured delivery service where suitable for the value and nature of the Artwork.
6.3 Delivery will be made to the address provided by the Buyer at checkout. The Buyer is responsible for ensuring that all delivery details are accurate and complete.
6.4 Delivery dates and timeframes are estimates only and are not guaranteed.
6.5 Arthoods is not the carrier and does not itself undertake transportation unless expressly stated otherwise.
6.6 Arthoods shall not be responsible for delay or failure in delivery caused by:
inaccurate address or contact details provided by the Buyer;
failed delivery attempts;
customs clearance or border delays;
courier disruption or carrier failure;
events outside Arthoods’ reasonable control; or
the Artist’s failure to dispatch within expected timeframes.
6.7 If additional delivery, return, storage, customs, or administrative costs arise due to incorrect information supplied by the Buyer or failure by the Buyer to accept delivery, Arthoods reserves the right to require the Buyer to pay those additional costs to the extent permitted by law.
7. Risk and Title
7.1 Risk in the Artwork passes to the Buyer upon delivery of the Artwork to the Buyer or to a person identified by the Buyer to take possession of it, unless applicable law requires otherwise.
7.2 Legal title to the physical Artwork passes only when full payment has been received in cleared funds.
7.3 If the Buyer fails without good reason to accept delivery, risk may pass at the time delivery would otherwise have taken place, to the extent permitted by law.
8. International Orders
8.1 Arthoods may permit orders for delivery outside the United Kingdom.
8.2 For international orders, unless stated otherwise, the Buyer is responsible for:
customs duties;
import taxes or VAT;
brokerage, handling, or clearance fees; and
compliance with local import laws and requirements.
8.3 Arthoods is not responsible for delays, storage fees, seizures, or other losses arising from customs procedures, import restrictions, or local regulations in the destination country.
9. Buyer Cancellation Rights
9.1 This clause applies only if you are purchasing as a consumer and mandatory law gives you a right to cancel.
9.2 Subject to applicable law and any legal exceptions, a consumer may have the right to cancel the contract within 14 days after the day on which the consumer, or a person identified by the consumer, receives the Artwork.
9.3 To exercise any right to cancel, the Buyer must contact Arthoods by a clear written statement before the cancellation period expires.
9.4 If a cancellation right is validly exercised:
the Buyer must return the Artwork without undue delay and within any period required by law;
the Buyer must take reasonable care of the Artwork while it is in their possession;
the Buyer may be responsible for the direct cost of return shipping unless applicable law provides otherwise; and
Arthoods may reduce the refund to reflect any loss in value resulting from handling beyond what is necessary to inspect the Artwork, where permitted by law.
9.5 Nothing in these Terms affects any statutory rights that cannot lawfully be excluded or limited.
10. Returns, Damage, Defects, and Misdescription
10.1 All requests relating to cancellation, return, damage, defect, or material misdescription must be submitted to Arthoods in the first instance.
10.2 The Buyer should inspect the Artwork promptly upon delivery and notify Arthoods without undue delay if the Artwork:
arrives damaged;
is defective; or
is materially different from its description.
10.3 Arthoods may request supporting evidence, including:
the order number;
photographs of the Artwork;
photographs of the packaging; and
a description of the issue.
10.4 Arthoods may coordinate the resolution with the relevant Artist and, where appropriate or legally required, may arrange:
a return;
a refund;
a replacement, where possible; or
another reasonable remedy.
10.5 Arthoods reserves the right to require return of the Artwork before issuing a refund, unless applicable law provides otherwise.
10.6 No remedy will be available for damage caused after delivery by misuse, mishandling, improper storage, unauthorised alteration, or failure to follow care instructions.
11. Refunds
11.1 Any refund due under these Terms will be made to the original payment method unless otherwise agreed or required by law.
11.2 To the extent permitted by law, Arthoods may withhold a refund until:
the returned Artwork has been received; or
the Buyer has provided satisfactory evidence of return,
whichever occurs first.
11.3 Refunds will be processed within any time period required by applicable law, but the time taken for funds to appear may vary depending on the payment provider or card issuer.
11.4 Where required by law, a refund following valid consumer cancellation will include the original standard outbound delivery charge. Additional delivery charges chosen by the Buyer beyond standard delivery may be excluded where permitted by law.
12. Intellectual Property
12.1 All intellectual property rights in and to the Site, including its content, layout, text, graphics, and branding, belong to Arthoods or its licensors.
12.2 Copyright and all other intellectual property rights in the Artwork remain with the Artist or relevant rights holder unless expressly transferred in writing.
12.3 The purchase of an Artwork transfers ownership of the physical item only, where applicable, and does not transfer any copyright, reproduction rights, commercial rights, or other intellectual property rights in the Artwork.
12.4 The Buyer may not reproduce, publish, distribute, licence, or commercially exploit the Artwork without the prior written consent of the relevant rights holder.
13. Limitation of Liability
13.1 Nothing in these Terms excludes or limits liability for:
death or personal injury caused by negligence;

indirect, incidental, special, or consequential loss;
loss of profit, revenue, business, opportunity, goodwill, or anticipated savings;
delay or failure caused by Artists, couriers, customs authorities, payment processors, or other third parties; or
circumstances outside Arthoods’ reasonable control.
13.3 Subject to clause 13.1 and to any non-excludable rights of consumers, Arthoods’ total liability arising out of or in connection with any order shall not exceed the amount paid by the Buyer for the relevant Artwork.
13.4 Nothing in these Terms affects a consumer’s mandatory statutory rights, including rights relating to goods that are not as described, not of satisfactory quality, or not fit for purpose, where applicable.
14. Suspension, Fraud, and Disputes
14.1 Arthoods reserves the right to suspend processing of an order, withhold release of funds, delay completion of a transaction, cancel an order, or take other reasonable action where it considers this necessary to investigate:
suspected fraud or unlawful activity;
authenticity concerns;
payment issues;
damage claims;
chargebacks;
disputes between Buyer and Artist; or
breach of these Terms or any related agreement.
14.2 The Buyer agrees to cooperate with any reasonable request for information made by Arthoods in connection with such investigation or dispute.
15. Privacy and Data Sharing
15.1 Personal data submitted in connection with an order will be processed in accordance with the Arthoods Privacy Policy.
15.2 The Buyer acknowledges that Arthoods may share relevant personal data with the Artist, courier, payment processor, and other service providers to the extent reasonably necessary for order fulfilment, customer support, fraud prevention, and legal compliance.
16. General
16.1 Arthoods may update these Terms from time to time. The version in force at the time an order is placed will apply to that order.
16.2 If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be deemed severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
16.3 No failure or delay by Arthoods in exercising any right or remedy shall operate as a waiver of that or any other right or remedy.
16.4 These Terms constitute the entire agreement between Arthoods and the Buyer in relation to the subject matter of these Terms, except in the case of fraud or fraudulent misrepresentation.
16.5 A person who is not a party to these Terms shall have no right to enforce them except where applicable law provides otherwise.
17. Governing Law and Jurisdiction
